A. Terms & Conditions (T&Cs)

1. Scope

These Terms & Conditions apply to all orders placed by consumers (Section 13 BGB) and businesses (Section 14 BGB) via the online stores www.4beatzfashion.com and www.4beatz.store operated by 4BeaTz – Music & Fashion GbR (“we/us”).

3. Offers and conclusion of contract

(1) Product listings in the shop are not binding offers, but invitations to place an order.

(2) By clicking “Buy” , you submit a binding offer (Section 145 BGB). A contract is formed when we accept by sending an order confirmation by e‑mail or by dispatching the goods.

(3) We do not store the full contract text. Relevant order data are included in the order confirmation.

4. Prices, shipping costs, payments

(1) All prices are stated in Euro and include statutory VAT (unless the small‑business regime pursuant to Section 19 UStG is indicated). VAT ID: to be added.

(2) Shipping costs: depending on destination country €4.50 to €23.79 ; the exact amount is shown at checkout.

(3) Payment methods: Credit card (via Shopify Payments), PayPal , Sofort/Klarna , Klarna (other shop‑enabled methods as displayed at checkout).

5. Delivery area and times

(1) We deliver to the countries offered at checkout.

(2) Delivery time: approx. 3-7 business days from contract conclusion/payment; for print‑on‑demand items, lead times may reasonably extend in peak periods.

(3) Carriers: eg, DHL/DPD/UPS depending on availability.

6. Retention of title

Goods remain our property until paid in full (Section 449 BGB).

7. Right of withdrawal & exclusions

(1) Consumers enjoy a 14‑day right of withdrawal for distance contracts. Details are set out in the Right of Withdrawal (Section B).

(2) No withdrawal right for goods made to customer specifications or clearly personalized (Section 312g (2) No. 1 BGB). We currently do not offer personalization unless expressly stated on a product page.

8. Returns

Please request a return via info@4beatzfashion.com (include order number). Unpaid/collect shipments cannot be accepted.

9. Statutory warranty

Statutory warranty rights apply (Sections 434 et seq., 437 BGB). No additional commercial guarantee is granted unless explicitly stated per product. Minor, technically unavoidable deviations in print, color or material that are reasonable do not constitute a defect.

10. Liability

(1) We are liable without limitation for intent and gross negligence and for injury to life, body or health.

(2) For slight negligence, we are liable only for breach of an essential contractual duty (cardinal duty), limited to foreseeable, typical loss.
(3) Liability under the German Product Liability Act remains unaffected.

11. Vouchers & promotions

Conditions (validity, minimum order, combinability, etc.) are communicated with each promotion.

12. IP & usage rights

Our designs, logos and content are protected. Any use beyond what is necessary for normal use of the purchased goods requires prior consent. Usage rights transfer only upon full payment and only to the extent necessary for contractual use of the goods.

13. Alternative dispute resolution

The EU Commission provides an Online Dispute Resolution (ODR) platform. We are currently not willing and not obliged to participate in consumer dispute resolution before a consumer arbitration board (Section 36 VSBG).

14. Final provisions

(1) German law applies, excluding the UN Sales Convention (CISG).
(2) If the customer is a merchant , exclusive venue is Bochum, Germany . Consumers retain their statutory venues.
(3) Contract language is German. This English version is for convenience only.

B. Right of Withdrawal (Consumer Information)

Right to withdraw

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. For partial deliveries, the period starts when the last item is received.

To exercise the right of withdrawal, you must inform us ( 4BeaTz – Music & Fashion GbR, Heribertistraße 40, 44866 Bochum, Germany, info@4beatzfashion.com, +49 155 61531050 ) of your decision to withdraw by an unequivocal statement (eg, e‑mail). You may use the model withdrawal form below, but it is not mandatory. Sending the notification before the period expires is sufficient.

Effects of withdrawal

(1) We will reimburse all payments received from you, including delivery costs (except extra costs resulting from you choosing a non‑standard delivery), no later than 14 days from the day on which we receive your withdrawal notice. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier (Section 357 BGB). As a service commitment, we aim to complete refunds within 7 days of receiving the returned goods. We will use the same means of payment that you used, unless otherwise agreed.

(2) You must send back the goods without undue delay and in any event no later than 14 days from the day on which you informed us of the withdrawal, to the address above. The deadline is met if you dispatch the goods before it expires.
(3) You bear the direct cost of returning the goods.
(4) You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Note: Try on textiles only as customary in a store; worn or washed items may lead to compensation for loss in value.

Exclusion / early expiry

No withdrawal right applies, inter alia, to goods made to customer specifications or clearly personalized , or for sealed goods not suitable for return for health/hygiene reasons once unsealed, where applicable.

2. Hosting & platform (Shopify)

Our store is operated on Shopify (Shopify International Ltd., 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland). Processing may occur in Canada and the USA . Shopify uses EU Standard Contractual Clauses to safeguard international transfers. Details are available in Shopify's privacy information (linked in our store).

Legal bases: Art. 6 (1) (b) GDPR (contract/order fulfilment), (f) (operation/security), and (c) (legal obligations) where applicable.

3. Access data & log files

When you visit our pages, Shopify processes technical data (IP address, time, requested URL, user agent). Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in stability/security).

4. Cookies & consent (German TDDDG / GDPR)

We use cookies and similar technologies. Non‑essential tools (eg, analytics/marketing) are activated only with your prior consent (opt‑in pursuant to Section 25 TDDDG in conjunction with Art. 6 (1) (a) GDPR). You can adjust your choices at any time in the consent banner/preferences center .

5. Data we process & purposes

Categories: name, billing and shipping address, contact details, order information, payment transaction identifiers (no full card numbers), and communication data.
Purposes: order processing, customer service, store operation, fraud prevention, compliance with legal duties.

Recipients / categories:

Payment services: Shopify Payments (credit card), PayPal , Klarna/Sofort

Fulfillment/production: print‑on‑demand/production partners we commission

Carriers: e.g., DHL/DPD/UPS

IT/analytics/marketing providers as listed below, after consent

6. Customer account

If you create an account, we process master data, order history and login details (Art. 6 (1) (b) GDPR). We delete upon request or after purpose ends, subject to statutory retention.

7. Analytics & marketing tools (after consent)

Google Analytics 4 (GA4) via Google Tag Manager (Google Ireland Ltd.): statistics/usage analysis; IP anonymization; retention via property settings.

Meta Pixel (Meta Platforms Ireland Ltd.): conversion tracking/retargeting.

Shopify analytics : operational statistics.

Legal basis: Art. 6 (1) (a) GDPR and Section 25 TDDDG; you may withdraw consent at any time with effect for the future in the consent banner.

8. Communication

When you contact us (e‑mail/phone/contact form), we process your data to handle the request (Art. 6 (1) (b) and (f) GDPR). E‑mail provider: eg, Zoho Mail (if used).

9. Retention

Commercial/tax records are kept for 10 years (Sections 147 AO, 257 HGB). We delete other data once purposes cease and no retention duties apply.

10. Your rights (Art. 12-22 GDPR)

You have the rights to access, rectification, erasure, restriction, data portability, objection (Art. 21 GDPR), withdrawal of consent (Art. 7 (3) GDPR), and to lodge a complaint with a supervisory authority. The competent authority is typically the State Commissioner for Data Protection and Freedom of Information North Rhine-Westphalia (LDI NRW) .

11. International transfers

Where outside providers the EU/EEA are used, we ensure adequate safeguards (EG, Standard Contractual Clauses, Art. 46 GDPR).

12. Security

We apply technical and organizational measures (including TLS encryption) to protect your data.

13. Updates

We update this policy if our processing changes. Last updated: 02 Nov 2025.
